User Agreement

Genplify is an AI proficiency assessment and training platform. Your organisation has enrolled you to complete assessments and/or training modules through the Service. The Service will evaluate your proficiency across multiple dimensions of AI usage and generate individual scores and reports.

You may be provided with login credentials or a link to access the Service. You are responsible for maintaining the security of your account credentials. You must not share your login credentials with anyone or allow another person to take assessments on your behalf.

When you use the Service, we collect and process the following personal data: your name and email address (as provided by your organisation); your assessment responses, including answers, completion times, and interaction patterns; your proficiency scores and analytics; technical data such as IP address, browser type, and device information. This data is processed in accordance with our Privacy Policy, available at genplify.com.

Your personal data is used to: deliver the assessments and training modules; generate your individual proficiency scores and reports; provide your organisation’s administrators with aggregated and individual reporting on assessment outcomes; produce anonymised benchmarks (your data is aggregated with data from other users across multiple organisations in a way that does not identify you individually).

Your individual Assessment Results may be visible to designated administrators within your organisation. Genplify does not share your individual results with any third party without your organisation’s authorisation. Anonymised and aggregated data (which cannot be used to identify you) may be used by Genplify to produce industry benchmarks and research.

Genplify processes your personal data on behalf of your organisation (the Customer). Your organisation, as the data controller, is primarily responsible for responding to your data rights requests. However, you may also contact Genplify directly.

You have the right to: request access to the personal data we hold about you; request correction of inaccurate data; request deletion of your data (subject to your organisation’s instructions and applicable law); object to processing of your data in certain circumstances. To exercise these rights, please contact your organisation’s administrator in the first instance. You may also contact Genplify directly at legal@genplify.com.

If you are located in the EEA or UK, you have additional rights under the GDPR/UK GDPR, including the right to data portability, the right to restrict processing, and the right to lodge a complaint with your local data protection authority. Please refer to our Privacy Policy for full details.

You agree to: complete assessments honestly and to the best of your ability; not use external assistance, AI tools, or other resources during assessments unless the specific assessment instructions state otherwise; not copy, share, or distribute assessment questions, content, or materials; not attempt to manipulate, reverse-engineer, or circumvent the assessment or scoring system. Violations of assessment integrity may result in invalidation of your results and may be reported to your organisation.

All assessment questions, training content, scoring methodologies, and platform features are the intellectual property of Genplify or its licensors. You are granted a limited, non-exclusive, non-transferable right to use the Service for the purpose of completing assessments and training modules. You may not copy, reproduce, distribute, or create derivative works from any part of the Service.

The Service provides assessment data for informational and developmental purposes. Assessment Results are not a definitive measure of your professional capabilities and should not be relied upon as the sole basis for any employment decision.

Genplify does not make employment decisions about you. Any decisions regarding your employment, performance evaluation, training, promotion, or termination are made by your organisation, not by Genplify. If you have concerns about how your Assessment Results are being used by your organisation, please raise them with your organisation’s HR department.

To the maximum extent permitted by law, Genplify’s total aggregate liability to you in connection with the Service shall not exceed the fees paid by your organisation to Genplify that are attributable to your individual use of the Service during the twelve (12) months preceding the event giving rise to the claim. Genplify shall not be liable for any indirect, incidental, or consequential damages, including any impact on your employment or career.

Nothing in this Agreement limits your rights under the mandatory laws of the country in which you are employed or habitually resident.

This Agreement is governed by the laws of Hong Kong Special Administrative Region. Any dispute arising from this Agreement shall be subject to the jurisdiction of the courts of Hong Kong, without prejudice to any mandatory jurisdiction provisions applicable under the laws of your country of employment or habitual residence.

Genplify may update this User Agreement from time to time. You will be presented with the updated User Agreement and asked to confirm your acceptance the next time you access the Service following any material change. Continued use after such acceptance constitutes agreement to the updated terms.
